FMLA Form WH-385: Military Caregiver Certification

Employers can require this certification when an employee requests FMLA military caregiver leave, up to 26 weeks, to care for a current servicemember with a serious injury or illness. The servicemember's health care provider confirms the injury or illness was incurred or aggravated in the line of duty on active duty, that treatment is under way, and estimates the continuous, scheduled or intermittent care needed.

Who completes it

The employer or employee completes Section I and the employee or servicemember Section II; the servicemember's health care provider completes Section III, Parts A to C, as a DOD, VA, TRICARE network, non-network TRICARE or other FMLA health care provider.

Submitting and payment

How to submit it
Return the completed form to the patient or employee, who gives it to the employer; it is never sent to the Department of Labor. The employer must allow at least 15 calendar days.

Good to know

  • If you cannot make the military-related determinations, the form lets you rely on an authorized DOD representative, such as a DOD recovery care coordinator.
  • Classify the condition as Very Seriously Ill/Injured, Seriously Ill/Injured, Other, or None of the above; with None, the employee may need a WH-380-F instead.
  • Avoid 'lifetime', 'unknown' or 'indeterminate'; give best-estimate dates, appointment durations and the frequency and duration of intermittent care over the next six months.
  • Employers must accept invitational travel orders or authorizations (ITOs or ITAs) as sufficient certification, and recertification is not allowed for this leave.

How this list is checked

A form is listed only after its name and number were confirmed on the issuing agency’s or insurer’s own website, or in the form itself. Each entry links to that source. The list was last checked in October 2026. Forms and their requirements change without notice, so check the official page for the current version before you complete one.

Frequently asked questions

Who can complete form WH-385?

Section III can be completed by a DOD health care provider, a VA health care provider, a DOD TRICARE network or non-network authorized private provider, or another health care provider as defined in 29 C.F.R. 825.125. The provider limits answers to the servicemember's condition and leaves out genetic information.

Is form WH-385 available in Spanish?

Yes. The Department of Labor's Wage and Hour Division posts English and Spanish versions of WH-385, revised June 2020, under OMB control number 1235-0003. Veterans are covered by a separate form, WH-385-V, which asks different questions about the veteran's discharge and condition.
