QME Form 123: QME/AME Conflict of Interest Disclosure

California QMEs and AMEs use this form to tell the parties they have a disqualifying conflict of interest under 8 CCR 41.5, or, after reviewing a party's allegation, that no such conflict exists. In represented cases the parties then use the bottom section to object to the evaluator or to waive the conflict and keep the evaluator.

Who completes it

The evaluator completes the notice and signs the declaration on page 1. Each represented party or attorney completes the objection or waiver section.

Submitting and payment

How to submit it
The evaluator mails it to the parties within five business days of learning of the conflict, or of receiving a party's notice; if the employee is unrepresented, a copy also goes to the DWC Medical Unit.
Who pays
The form does not address fees.

Good to know

  • Disqualifying conflicts are familial, significant financial (employment, a 5 percent ownership interest, or 5 percent of income from referrals or contracts other than MPN contracts), professional affiliation, or any other relationship raising doubts about impartiality.
  • Treating physicians, UR reviewers, surgery centers and other vendors count only when their treatment, decision or service is disputed.
  • Represented parties have five business days to object or waive, serving the form on the evaluator and the opposing party; an objector also asks the Medical Unit for a replacement QME.
  • An evaluator may also withdraw when a relationship would make the evaluation unethical (8 CCR 41.5(e)). Instructions are on page 2.

How this list is checked

A form is listed only after its name and number were confirmed on the issuing agency’s or insurer’s own website, or in the form itself. Each entry links to that source. The list was last checked in October 2026. Forms and their requirements change without notice, so check the official page for the current version before you complete one.
