NYL GBS Form 123769: Family Member Care Certification

New York Life Group Benefit Solutions uses form 123769 when its Leave Solutions unit administers an employee's request for FMLA or state leave to care for a family member. It is NYL GBS's version of the WH-380-F. The family member's provider answers questions on the condition and the care needed for continuous, reduced-schedule or intermittent leave, by the return date printed at the top.

Who completes it

The employee completes Section I with the family member's name, relationship and care to be given; the family member's health care provider completes Section II, Subsections A to D as they apply, and signs.

Submitting and payment

How to submit it
The completed form, all pages, goes to NYL GBS Leave Solutions by email, fax or mail; the employer must allow at least 15 calendar days to return it.
Who pays
The form sets no fee and names no payer for the provider's certification.

Good to know

  • If the certification comes back incomplete or insufficient, the employee gets at least 7 calendar days to cure the deficiency.
  • For leave under the California Family Rights Act or the Connecticut Family and Medical Leave Act, the form tells providers not to include diagnosis information.
  • For an adult child 18 or older, describe the specific activities of daily living the child needs help with, such as bathing, cooking or using transportation.
  • Each leave type has a required subsection: B for continuous, C for reduced schedule, D for intermittent; a missing one makes the form insufficient.

How this list is checked

A form is listed only after its name and number were confirmed on the issuing agency’s or insurer’s own website, or in the form itself. Each entry links to that source. The list was last checked in October 2026. Forms and their requirements change without notice, so check the official page for the current version before you complete one.

Frequently asked questions

How long does the employee have to return NYL GBS form 123769?

The employer must give at least 15 calendar days, and the return date is printed in the header as 'Must Be Returned By'. If NYL GBS finds the certification incomplete or insufficient, the employee gets at least 7 more calendar days to fix it.

Should genetic information be included on the NYL GBS certification?

No. Under GINA, and CalGINA where it applies, providers are asked not to give genetic information unless leaving it out would make the certification incomplete. For leave under the District of Columbia Family and Medical Leave Act, genetic information should never be provided.

What does the intermittent section of form 123769 ask?

Subsection D asks for the dates the patient needs care and two separate estimates over the next 6 months: the maximum frequency and duration of office visits or treatments, and the maximum frequency and duration of episodes of incapacity. It also asks what care the patient needs during that time.
